COMPLIANCE UNDER SEXUAL HARASSMENT OF WOMEN AT WORKPLACE (PREVENTION, PROHIBITION & REDRESSAL) ACT
As per
Sexual Harassment of Women at Workplace Act, 2013, hereinafter referred
to as POSH Act or Act, provides ‘Constitution of Internal Complaints Committee’.
The Act provides that every employer of a workplace shall, by order in writing,
constitute a Committee to be known as ‘Internal Complaint Committee’
(hereinafter referred to as ICC). Provided that where the offices or administrative
units of the workplace are located at different places or divisional or
sub-divisional level, the ICC shall be constituted at all administrative units
or offices.
Penalty for non-compliance of the
Act:
The employer will be liable for punishment with the fine upto Rs. 50,000/- if
(a) They have not constituted an ICC or have failed to act upon the recommendation of the ICC or
(b) Has failed to make disclosure in or file its Annual Report or;
(c) Has contravened or attempted to contravene or abets contravention of other provisions of the Act or any rules made under the Act.
